Terms of use

1 · Scope

These terms apply to the use of Miguvino in the apps for iPhone and Android and on the web at app.miguvino.com. The provider is Michael Bolliger, Earhart-Strasse 19, 8152 Glattpark (Opfikon), Switzerland ("we"). By signing in you accept these terms and take note of the Privacy statement.

Miguvino is for people aged 18 and over.

2 · Account

You need an account to use Miguvino. You sign in with a code we send to your e-mail address, or with Apple or Google. You keep your access secret and are responsible for everything that happens through your account. An account belongs to one person.

3 · Plans and credits

There are the plans Free, Plus and Pro. Prices, included credits and what each plan covers are listed under Pricing. Free costs nothing. A paid plan or a credit pack can be bought only when Miguvino offers a payment method for it; the price shown at purchase applies.

• Credits pay for the AI's work: a conversation with the assistant costs one credit, a page read by an image model five.
• A plan's credits are granted again at the start of each billing period. A plan's unused credits expire at the end of the period.
• Bought credits do not expire and are used after the plan's credits.
• If a conversation fails for a reason on our side, the credit is returned.
• A change to a larger plan applies at once. A change to a smaller plan and a cancellation apply at the end of the current period; nothing is refunded for the current period.
• Price changes apply to future periods. We announce them beforehand in the app or by e-mail; you can cancel at the end of the current period.

4 · AI features

Miguvino recognises wines from speech, labels and invoices and suggests entries. These results can be wrong. You check what you confirm. Which data goes to whom for this is set out in the Privacy statement.

5 · Wine catalog, ratings and offers

Wine data, critic ratings, and merchants' prices and offers come from public sources and from third parties. We give no warranty for their accuracy, completeness or currency. Miguvino sells no wine. A purchase from a merchant is a contract between you and the merchant.

6 · Your content

What you record — bottles, notes, ratings, purchases, invoices, photos, lists — remains yours. You grant us the right to store this content, process it technically and show it to the people you share it with, as far as this is needed to operate Miguvino.

You upload only content you hold the rights to. If you name other people in an entry or show them in a photo, you are responsible for their agreement.

7 · Friends

You can end a friendship and block a person at any time.

8 · Not allowed

• content that breaks the law or infringes the rights of others;
• querying Miguvino automatically, copying the catalog or circumventing limits;
• reselling Miguvino or using it as part of your own offering;
• using invitations and mentions to harass others;
• attacks on Miguvino, its servers or other users.

In case of a breach we can remove content and block an account. As a rule we write first; in case of a serious breach we block at once.

9 · Availability and liability

We do not guarantee any particular availability.

We are liable without limit for intent and gross negligence. Otherwise, as far as the law permits, our liability is limited to the amount you paid us in the twelve months before the damage. We are not liable for indirect damage, lost profit and data loss, as far as the law permits.

10 · Deleting your account and ending

You can delete your account at any time; it is deleted 14 days later.

We can end the contract with 30 days' notice and give you the chance to export your data first. In case of a serious breach of section 8 we can end it at once. For a paid plan, when we end the contract for a reason other than a breach, we refund the share of the unused period.

11 · Changes

We can change these terms. We announce a change at least 30 days in advance in the app or by e-mail. If you keep using Miguvino afterwards, the new version applies; otherwise you can delete your account before, or cancel a paid plan as of the change.

12 · Law and jurisdiction

Swiss law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is the provider's seat, unless a mandatory place of jurisdiction applies. For consumers, the place of jurisdiction at their residence and the mandatory protective provisions of their country of residence remain unaffected.
